Public offer agreement

1. Terms and definitions

1.1. In this public offer, unless the context requires otherwise, the following terms shall have the meanings set forth below and constitute an integral part of this Offer:

Pre-Order — a properly completed and submitted Buyer’s request (by filling out the relevant fields on the website in the “Cart” and “Checkout” sections), addressed to the Seller, for the sale and delivery of a Product marked “Pre-Order” from the website https://wonderwandershop.com/ to the address specified by the Buyer.

A Pre-Order does not guarantee the availability of the Product. Each Order and Pre-Order must be additionally confirmed by the Seller to the Buyer.

2. General provisions

2.1. This Public Offer (hereinafter — the “Agreement”) constitutes the official proposal of Individual Entrepreneur Mukhtarova Nurdzhakhan Oktay kyzy to any legally capable individual to enter into a retail sale and purchase agreement for Products under the terms specified herein. This Offer contains all essential terms of such an agreement.

2.2. Relations between the parties in the field of consumer protection are governed by the Civil Code of the Russian Federation, the Law of the Russian Federation “On Protection of Consumer Rights”, the Resolution of the Government of the Russian Federation “On Approval of the Rules for the Sale of Goods by Remote Means”, and other applicable federal laws and legal acts of the Russian Federation.

2.4. By placing an Order on the website https://wonderwandershop.com/, by phone, or by subscribing/registering on the website, the Buyer confirms that they have read, understood, and unconditionally accepted these Terms.

2.5. All textual information and graphical materials related to the Products displayed on the website https://wonderwandershop.com/ are the property of the Seller or its contractors. Viewing or printing information from the website   is permitted solely for personal use.

3. Subject of the agreement and product price

3.1. The Seller undertakes to transfer, and the Buyer undertakes to accept and pay for the Products under the terms of this Agreement.
Ownership of the ordered Products passes to the Buyer at the moment of actual transfer of the Product to the Buyer and upon full payment of its cost. The risk of accidental loss or damage to the Product passes to the Buyer at the moment of its actual transfer.

3.2. Product prices are determined unilaterally by the Seller and are indicated on the pages of the online store at https://wonderwandershop.com/.

3.3. All prices are quoted in Russian rubles (RUB).

3.4. The offer to conclude a sale contract for a specific Product remains valid for as long as the Product is displayed on the Seller’s website https://wonderwandershop.com/ and subject to the Product’s availability in stock.

4. Moment of contract conclusion

4.1. The text of this Agreement constitutes a public offer in accordance with Articles 435 and Part 2 of Article 437 of the Civil Code of the Russian Federation.

4.2. The Agreement concluded as a result of the Buyer’s acceptance of this Offer is considered a contract of adhesion, to which the Buyer adheres without any exceptions or reservations.

4.3. The act of placing an Order by the Buyer constitutes unconditional acceptance of the terms and conditions of this Agreement.
A Buyer who purchases a Product through the Seller’s online store https://wonderwandershop.com/ (by placing an order) shall be deemed to have entered into a contractual relationship with the Seller under the terms of this Agreement.

5. Rights and obligations of the parties

5.1. The Seller undertakes to:

5.1.1. Fulfill all obligations to the Buyer in accordance with the terms of this Agreement and applicable law from the moment of its conclusion.
The Seller reserves the right to suspend the fulfillment of obligations under this Agreement in the event of force majeure circumstances as defined in Section 10 of this Agreement.

5.1.2. Process the Buyer’s personal data and ensure its confidentiality in compliance with current legislation.

5.2. The Seller has the right to:

5.2.1. Modify this Agreement, Product Prices, service fees, methods and timelines of payment and delivery at any time unilaterally by publishing the updated information on the Seller’s website https://wonderwandershop.com/.
All amendments take effect immediately upon publication and are deemed communicated to the Buyer from that moment.

5.2.2. Record telephone conversations with the Buyer.
In accordance with Clause 4, Article 16 of the Federal Law “On Information, Information Technologies and the Protection of Information”, the Seller undertakes to prevent any unauthorized access to such information and/or its transmission to third parties not directly involved in the processing of the Buyer’s Orders and to promptly detect and prevent such incidents.

5.2.3. Assign its rights and obligations under this Agreement to third parties without prior consent from the Buyer.

5.3. The Buyer undertakes to:

5.3.1. Review the contents and terms of this Agreement, as well as the Product prices offered by the Seller on the website https://wonderwandershop.com/, prior to concluding the Agreement.

5.3.2. Enter accurate personal information when placing an Order, either independently on the website or through a customer service representative using available means.

5.3.3. Provide the Seller with all necessary data to identify the Buyer and ensure correct delivery of the ordered Product.

5.3.4. Pay for the ordered Product and delivery in accordance with the terms of this Agreement.

5.3.5. Review all relevant information provided by the Seller on the website https://wonderwandershop.com/, including but not limited to the sections: Buying Guide, Payment, Delivery, Returns, and Privacy Policy.

5.3.6. Refrain from using Products purchased on https://wonderwandershop.com/ for commercial or business purposes.

6. Order acceptance

6.1. After placing an Order, the Buyer will receive a confirmation email containing the order details, including the list of Products, delivery address, and total cost.
Delivery costs for try-on options are calculated separately, depending on the Buyer’s location. Full delivery pricing information is available in the Delivery section of the website.

6.2. The Order is considered accepted for processing once the Buyer receives an email confirmation to the address provided in the registration form, or when the website displays an on-screen confirmation message with the Order number.

6.3. The Seller reserves the right to cancel the Buyer’s Order at the confirmation stage.

6.4. The Seller reserves the right to verify the details of the Order with the Buyer by phone and/or via text messenger.
If the Seller is unable to reach the Buyer within two (2) days, the Order will be cancelled.
In cases where the Buyer has made a prepayment, the Seller will refund the payment to the same bank account from which the payment was made.

6.5. After an Order is placed, the Buyer will receive information regarding the estimated delivery date and cost via phone and/or text messenger.
The delivery date depends on the availability of the ordered Products in stock and the time required for processing and shipping.

6.7. The Seller also reserves the right to determine the available payment methods and services for the Buyer depending on the Buyer’s previous purchase history and order volume.

7. Delivery of products

7.1. The Buyer undertakes to accept the Order within the agreed delivery timeframe.
The delivered Product may be handed over to the Buyer personally, or, in their absence, to any person presenting confirmation of the Order or another document proving authorization to receive it.

7.2. The Buyer may collect the Order independently from any of the Seller’s physical retail locations.

7.3. The Seller strives to meet the agreed delivery timelines but is not liable for delays caused by unforeseen circumstances beyond its control, including delays attributable to third-party courier services.

7.4. The Buyer may cancel all or part of the Order at any time prior to its transfer to the courier service, or within 7 days after receipt of the Product.

7.5. Ownership and the risk of accidental loss or damage to the Product pass to the Buyer at the moment the Product is accepted from the courier.
The Buyer’s signature on the delivery note issued by the Seller or courier confirms the transfer of ownership.

7.6. Together with the Product, the Seller provides a return form containing information on return procedures and deadlines.

7.7. For Buyers residing outside the Russian Federation, orders are shipped excluding local taxes and duties.
The delivery price does not include any such taxes or customs fees.

8. Returns and exchanges

8.1. The Buyer has the right to cancel an order at any time prior to receiving the Product, as well as within seven (7) calendar days after receipt, without providing any reason.

8.2. The Buyer has the right to exchange a Product if it does not fit in shape, size, style, color, or configuration.
The exchange period is 14 days, excluding the day of purchase.
A Product may be returned or exchanged only if it retains its marketable condition (packaging, seals, labels, if any), consumer properties, completeness, and the document confirming the fact and conditions of purchase (sales or cash receipt).

8.3. To return a Product of proper quality (including for the purpose of exchange), the Buyer must carefully package the Product with all accessories and documents included in the Product documentation, and attach the completed Return Form.

8.4. The return procedure for a Product of improper quality is carried out as described in Clause 7.3 of this Agreement.
The return request must specify the defect of the Product being returned by the Buyer.

8.5. The cost of returning the Product shall be borne by the Buyer.
The return can be arranged in one of the following ways:

Returning the Product through a delivery service;

Returning the Product independently through any courier company.

8.6. Refunds for returned Products shall be issued within ten (10) calendar days from the date of the corresponding request (Article 22 of the Law of the Russian Federation “On Protection of Consumer Rights”).
In the case of returning a Product of improper quality, the Buyer will be refunded both the cost of the Product and the cost of delivery.

9. Payment methods

9.1. The Buyer may pay for the Product using the following methods:

• In cash or by card upon delivery within Moscow (within the MKAD);
• Online payment directly on the website https://wonderwandershop.com/;
• Online payment via a link provided by the Seller’s manager through the YooKassa payment service.

9.2. Detailed information on available payment and delivery methods is provided in the corresponding sections of the website: “Payment” and “Delivery.”

10. Force majeure

10.1. Neither Party shall be held liable for full or partial non-fulfillment of its obligations under this Agreement if such non-fulfillment results from force majeure circumstances that arise after the execution of the Agreement.
“Force Majeure Circumstances” shall mean extraordinary events or circumstances that the Party could not have foreseen or prevented by reasonable means.
Such events include, but are not limited to: strikes, floods, fires, earthquakes, and other natural disasters, wars, military actions, actions of Russian or foreign governmental authorities, or any other events beyond the reasonable control of either Party.

10.2. Changes in legislation or regulatory acts directly or indirectly affecting either Party shall not be considered Force Majeure.
However, in the event of such changes preventing either Party from fulfilling its obligations under this Agreement, the Parties shall promptly agree upon necessary actions to resolve the issue and ensure further execution of this Agreement.

11. Confidentiality and protection of personal data

11.1. The Buyer’s personal data is processed in accordance with Federal Law No. 152-FZ “On Personal Data” and the Privacy Policy available on the Seller’s website at https://wonderwandershop.com/page/policy.

11.2. By providing their personal data when registering on the website or placing an order, the Buyer consents to the processing, storage, and use of such data by the Seller, including automated and non-automated means, for the following purposes:

Registration of the Buyer on the website;

Execution and fulfillment of the Seller’s obligations to the Buyer;

Evaluation and analysis of the Online Store’s performance;

Analysis of purchasing behavior and preferences;

11.5. The Buyer grants the Seller the right to use the provided personal data for the purpose of targeted advertising and improving the quality of customer service, provided that such processing complies with the Privacy Policy.

11.6. The Seller shall not be liable for the disclosure of personal data if such disclosure was the result of unlawful actions by third parties or occurred through communication channels beyond the Seller’s control.

11.7. The Seller reserves the right to use “cookies” and other technical means to collect non-personalized data for statistical and analytical purposes, in accordance with the Privacy Policy.

12. Liability of the parties

12.1. In case of improper performance of their obligations under this Agreement, the Parties shall bear liability in accordance with the legislation of the Russian Federation.

12.2. All textual and graphic content on the website https://wonderwandershop.com/, including trademarks, product images, and descriptions, are the intellectual property of the Seller or its licensors.
Any unauthorized copying or use of such materials is strictly prohibited and may result in legal liability.

13. Miscellaneous Provisions

13.1. If the Client has any questions or claims, they may contact the Seller via email: customercare@wonderwandershop.com or by any other available method. The response time is 10 days from the date the question or claim is received (unless another period is established by the legislation of the Russian Federation).

13.2. Both parties will strive to resolve any disputes through negotiations. If an agreement cannot be reached, all disputes shall be settled in court in accordance with the legislation of the Russian Federation.
